Smartestree.com (hereafter referred to as "Smartestree" or "the Site") is owned and operated by NXTWORX LTD (Registration Number: 16270595), with its registered address at 50 Princes Street, Ipswich, Suffolk, England, IP1 1RJ, United Kingdom (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of and access to our website and any associated services.

By visiting or using Smartestree, you acknowledge that you have read, understood, and agree to abide by these Terms. If you do not consent to these Terms, you must discontinue your use of the Site immediately.

1. DEFINITIONS

  1. Company: Refers to NXTWORX LTD, operating under the laws of the United Kingdom, and providing services via Smartestree.com.
  2. Site: Includes all web pages located at Smartestree.com, any subdomains, and any related platforms where services may be accessed.
  3. Services: Denotes the range of academic writing assistance, consulting, or other educational support offered to customers through the Site.
  4. User / You / Client: Any individual or entity accessing or using the Site and its Services, whether by placing orders, making payments, communicating with support, or simply browsing.
  5. Order: An electronic request for Services submitted through the Site, detailing project specifications, deadlines, and any additional instructions.
  6. Writer / Expert: A professional (or team of professionals) who provides writing, research, or related services to the Client on behalf of the Company.
  7. Personal Account: A password-protected section of the Site that Users register for, which contains order history, communication tools, and account settings.
  8. Messaging System: The internal communication feature on the Site enabling direct interaction between Clients, Writers, and our Support Team.
  9. Product: The final written or otherwise delivered work resulting from the Services, intended solely as a reference or academic study aid.
  10. Personal Balance: Funds in a User’s account not yet allocated to a specific Order or refunded, which can be applied toward new or existing Orders.

2. ACCEPTANCE OF TERMS

  1. By accessing Smartestree, you confirm that:
    • You have reached the age of majority in your jurisdiction or have obtained permission from a parent/guardian if you are a minor.
    • You agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and any other guidelines posted on the Site.
  2. We reserve the right to update or modify these Terms at any time. Continued use of the Site after such changes indicates your acceptance of the updated Terms. It is your responsibility to periodically review these Terms for any modifications.

3. RESTRICTIONS AND ELIGIBILITY

  1. Prohibited Jurisdictions: You may not access or use our Services if you are located in, incorporated in, or otherwise subject to any jurisdiction embargoed or restricted by applicable laws or regulations (such as FATF-, EU-, OFAC-, or UK-sanctioned countries).
  2. If we find that you are accessing the Site from a jurisdiction where our Services are restricted, we reserve the right to block or terminate your account without notice.

4. ACCOUNT REGISTRATION

  1. Accuracy of Information: When creating a Personal Account, you must provide an active email address and choose a secure password. All registration information must be accurate and truthful. Providing false or incomplete data may result in suspension or cancellation of your account.
  2. Confidentiality: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity performed under your account is deemed to be conducted by you. If you suspect unauthorized access to your account, please change your password immediately and notify us.
  3. Age Requirement: You confirm that you are at least 16 years old (or have permission from a legal guardian if younger). If you are under your jurisdiction’s legal age, your guardian must review and agree to these Terms on your behalf.

5. SCOPE OF SERVICES

  1. Nature of Services: Smartestree provides assistance in the form of custom writing, research guidance, and educational support. Products are designed as reference materials and study aids.
  2. Academic Integrity: Our Products should never be submitted as your own official coursework, nor used for any form of academic dishonesty. You agree to adhere to all laws, academic policies, and institutional regulations that apply to you.
  3. Writer Bidding and Assignment: After you submit an Order, Writers may place bids to complete it. You can choose from among the available bids. Communication regarding the Order must remain within the Messaging System.

6. ORDER PLACEMENT AND PROCESS

  1. Submitting an Order: To request a Product or Service, fill out the order form on the Site. Provide clear, complete, and final details, including deadline, word count, references, formatting style, and any relevant instructions.
  2. Required Materials: If specific sources or references are critical, you must either upload them or make them available to the Writer promptly. Late submission of materials can lead to delays or additional charges.
  3. Tracking and Communication: You can track the status of your Order in your Personal Account. All communication with Writers must occur via the Messaging System; direct sharing of personal contact details is not permitted.

7. PRICING AND PAYMENT

  1. Placing an Order: It is free to post your Order requirements. Once you accept a Writer’s bid, you must deposit the agreed-upon fee into your Personal Balance.
  2. Accepted Payment Methods: We accept major credit cards including Visa, Mastercard, Discover, American Express, Maestro, JCB, and Diners Club International. Payment is deemed complete once the funds are authorized.
  3. Additional Work or Payment: If, upon reviewing your instructions, the actual scope of work is broader than anticipated or the complexity is higher, we may request extra time or payment to complete the project. You can accept or decline these changes.
  4. Tax Responsibility: You are responsible for any local taxes (e.g., VAT) depending on your jurisdiction.
  5. Automatic Release of Funds: In the event that you do not manually release payment for a completed Order or milestone, the funds may be automatically released after a specified period (e.g., 14 days after final delivery) unless you raise a dispute or request revisions in a timely manner.
  6. Price Modifications: We reserve the right to change our pricing structure or introduce new fees at any time, though any changes will apply only to Orders placed after the modifications are published.

8. REVISIONS

  1. Revision Requests: You may request revisions as long as payment has not been fully released to the Writer. Revisions must remain within the scope of the original instructions.
  2. Limitations: Repeated or unjustifiable revision requests may be declined. Once payment is fully released, revision requests cannot be made unless agreed upon in writing by both parties.

9. REFUND POLICY

  1. Eligibility: Refunds are granted when the delivered Product significantly deviates from your original instructions, or if the Services were not delivered at all.
  2. Ineligible Refunds:
    • Personal Use: If you have already used the delivered Product or integrated it into other work, refunds typically do not apply.
    • Academic Outcome: We do not guarantee grades, admissions, or any specific results. We only provide reference materials and academic guidance.
    • Exceeded Time Frame: Refund requests made more than six months after the original payment date are not valid.
    • Editing Services: For editing or proofreading services, we rely on the clarity and correctness of the initial material you provide. We do not issue refunds if the final Product’s deficiencies stem from issues in your supplied content.
  3. Processing: Approved refunds are generally processed within 3–5 business days. We do not cover external banking fees, possible delays, or anomalies in the refund process.
  4. Method: If a refund is granted, we attempt to credit it back via the original payment method.

10. PRODUCT USAGE AND INTELLECTUAL PROPERTY

  1. Personal Use Only: All delivered Products are intended solely for personal, non-commercial reference. You may not redistribute, publish, or replicate these materials without our express permission.
  2. Ownership: Until your Order is fully paid and closed, we retain exclusive ownership rights to any draft, outline, or final Product created for you. Upon final payment, you receive a license for personal use, subject to these Terms.
  3. Prohibition of Unauthorized Submission: Our work is meant to guide and supplement your own learning. Submitting our Products directly for academic credit or claiming them as your own is strictly prohibited.

11. PLAGIARISM AND ACADEMIC HONESTY

  1. Zero Tolerance: We uphold academic integrity. By using our Services, you agree not to engage in plagiarism, self-plagiarism, or any form of academic misconduct.
  2. Proper Attribution: You are responsible for citing any excerpts, paraphrases, or ideas from our delivered Product, following your institution’s guidelines.
  3. Client Liability: Any misuse of our Products, including presenting them as your own work, could lead to academic penalties. Smartestree and NXTWORX LTD are not responsible for consequences arising from unethical or improper use of our Products.

12. PERSONAL DATA AND SECURITY

  1. Privacy: We collect and process your personal data in accordance with our Privacy Policy (available on the Site). By using our Services, you consent to our collection, storage, and handling of your data.
  2. Security Measures: We employ reasonable technical and organizational safeguards to protect your information. However, no system is entirely foolproof, and we cannot guarantee absolute security of your data.

13. PROHIBITED CONDUCT

  1. Illegal or Harmful Activity: You must not use the Site to engage in unlawful acts, distribute malicious software, harass other users, or post content that is defamatory, obscene, or otherwise offensive.
  2. Interference: Any attempt to disrupt or compromise our networks, servers, or services—including the introduction of viruses or other harmful code—is strictly forbidden.
  3. Account Termination: We reserve the right, in our sole discretion, to terminate or restrict your account without notice if you engage in prohibited conduct or violate these Terms.

14. LIMITATION OF LIABILITY

  1. Site Availability: Smartestree is provided on an “as is” basis. We do not guarantee continuous availability or that the Site will be free of errors, viruses, or harmful components.
  2. No Warranties: Except as explicitly stated, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
  3. Indirect Damages: NXTWORX LTD, its employees, contractors, or affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our Site or Services, even if advised of the possibility of such damages.
  4. Applicable Law: Some jurisdictions may not allow the exclusion of certain warranties or liability. In such cases, our liability is limited to the extent permitted by law.

15. INTELLECTUAL PROPERTY RIGHTS

  1. Site Content: All text, graphics, logos, icons, images, and software found on Smartestree are owned or licensed by NXTWORX LTD unless otherwise noted. They may not be used without our prior written consent.
  2. Trademarks: Any trademarks, service marks, or brand names displayed on the Site remain the property of their respective owners. You are prohibited from using these trademarks without permission.

16. DISPUTE RESOLUTION AND GOVERNING LAW

  1. Governing Law: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law principles.
  2. Disputes: You agree to attempt good-faith negotiation with us regarding any dispute before taking formal legal action. If we cannot resolve the issue informally, disputes shall be settled by binding arbitration or in a court of competent jurisdiction in the United Kingdom, at our discretion.
  3. No Class Actions: All claims must be pursued on an individual basis. Class actions or collective proceedings are not permitted.

17. MODIFICATIONS

We reserve the right to alter or update these Terms at any time. Changes may be driven by evolving business practices, legal requirements, or enhancements to the Site. Any revised Terms will be posted on the Site with the “Last Updated” date. By continuing to use the Site after revisions are posted, you signify your acceptance of the updated Terms.

18. MISCELLANEOUS

  1. Entire Agreement: These Terms, along with our Privacy Policy and any other guidelines posted on the Site, comprise the entire agreement between you and NXTWORX LTD concerning your use of Smartestree.
  2. Severability: Should any provision of these Terms be deemed unenforceable, that provision will be modified only to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
  3. No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  4. Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
